Currently biocidal products containing notified active ingredients (see regulation 1451/2007/EC Annex II) are allowed to be put in circulation in Germany without authorization/registration, but in consideration of the transitional measures. This applies until a decision has been taken on the inclusion of the active ingredients of the product to Annex I or Ia of the biocidal products directive (BPD, directive 98/8/EC), but until May 13th, 2010 at the latest (see ChemG §28 ).
By publication of directive 2009/107/EC (amending directive 98/8/EG) in the official journal of the European Union dated October 6th, 2009 the so called Mini-Revision of the BPD was completed. Among other things it determines an extension of the deadline till may 14th, 2014 (see article 1, no.2). This means, that biocidal products containing notified active ingredients, in consideration of the transitional measures, are allowed to be put in circulation in Germany without authorization/registration till this new deadline, as long as no decision on the inclusion of the active ingredients of the product to Annex I or Ia of the BPD has been taken.
The directive entered into force on October 26th, 2009 and has to be transferred into national law by the Member States till May 14th, 2010.
