BACKGROUND

In the past, the trade in and uncontrolled use of biocide products have been a frequent cause of environmental and health problems. Hitherto, risk reduction measures have tended to be reactive (i.e. taken after harm has occurred) than pro-active (i.e. preventing harm from happening in the first place).

The provisions of the Biocidal Products Directive (in short: BPD) are intended to counter these problems and ensure that all biocides are tested before they are allowed to go on sale. The decision by the authorities on whether or not to license a biocide is based on an assessment of the risks of the product to human life/health and to the environment, and on its efficacy as established according to the latest, uniform Europe-wide standards on efficacy testing (e.g. DVG, Afnor, Defra, etc.).

EQUIREMENT FOR THE LICENSING OF BIOCIDE PRODUCTS

The authority responsible for the licensing of biocide products in Germany is the Federal Institute for Work Safety and Occupational Medicine (abbreviated: baua), which evaluates the products on the basis of their chemical, physical and eco/toxicological properties. A risk assessment is carried out in order to establish whether biocides which are already on the market can continue to be sold and whether new biocides can be allowed into circulation (reasonableness of the products). A product that is subject to the licensing procedure may not be put onto the market until the responsible authority has given its express consent.

In view of the more stringent conditions and requirements relating to biocide products, a reduction can be expected in the large number of biocidal agents and products that currently exist. A market shake-out will, in turn, lead to greater market transparency, but also less choice for the consumers.
